Terms and Conditions
1. Introduction
1.1 The website located at www.takeandship.com (“Site”) is owned and operated by by SERGLOBEX ELEKTRONIK TICARET VE LOJISTIK HIZMETLERI LIMITED SIRKETI, a Türkiye company registered in Türkiye and Istanbul under company number, hereafter referred to as ‘takeandship’, ‘We’, ‘Us’, or ‘Our’ set out the following terms and conditions upon which takeandship offers registered takeandship members (collectively referred to as ‘Customers’) and herein referred to as ‘User’, ‘Recipient’, ‘You’ and ‘Your’ permission to use our services.
1.2 ‘Site’ means the website and the contents accessible at the URL link www.takeandship.com. ‘Services’ means all the services offered by us on the Site. ‘Goods’ or ‘Shipment’ or ‘Package(s)’ or ‘Parcel(s)’ means the product, merchandise or grocery product purchased by User.
“Goods” means products purchased by the User from a Supplier.
“Package” or “Parcel” means a physical parcel received by Take&Ship on behalf of the User.
“Shipment” means one or more Packages consolidated and dispatched to the User.
‘Supplier’ means the retailer, merchant or supermarket who sell Goods. ‘Turkey Delivery Address’ is takeandship’s warehouse, is also the address given to User during registration. ‘Shipment Address’ is the designated User address. ‘Carrier’ or ‘Courier’ is the third party company providing door-to-door package delivery service
1.3 Please read these Terms and Conditions carefully before you become a Registered Member. By creating an account, accessing the Site, or using any of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. you agree to be bound by these Terms and Conditions, which form a legal agreement between you and us and can only be amended with our consent. Your use of www.takeandship.com is also subject to our Privacy Policy.
1.4 You can access your order details and these Terms and Conditions at any time on-line from our website but we recommend that you store a copy of these terms on your computer or device for your reference offline.
1.5 We reserve the right to amend these Terms and Conditions from time to time. Any updated version will be published on the Site and will become effective upon publication. Changes will not apply retroactively to Services already purchased or Shipments already received by Take&Ship before the effective date of such changes.

1.7 These Terms and Conditions are written in English. In the event that these Terms and Conditions are translated into another language, the English version shall prevail in the event of any conflict or inconsistency.
2. Registration
2.1 You must read, agree with and accept all of the Terms and Conditions and the Privacy Policy, which include those terms of use expressly set out below and those incorporated by reference, before you may register to become a User.
2.2 We strongly recommend that, as you read these Terms and Conditions, you also access and read the information contained in the other pages and websites referred to herein, as they may contain further terms of use that apply to you as a User.
2.3 Services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our Services are not available to children (persons under the age of 18). You may not use the Site and/or the Services if you do not meet these eligibility criteria.
2.4 If you are registering as a business entity, you represent that you have the authority to bind the entity to this Agreement.
2.5 Upon successful registration, User shall be allocated a TURKEY address which the User may then provide to TURKEY on-line Suppliers as a delivery address (“Turkey Delivery Address”) when purchasing Goods.
2.6 The following is a non-exhaustive list of Services we offer: Takeforme, Shopping Assistance (described in condition 4 below), Takeforme (described in condition 5 below) and Supermarket Shopping (described in condition 6 below).
2.7 Due to the current situation, we unable to accept registration and ship to countries under sanction and in political unrest region. The following is a non-exhaustive list of Countries/Regions we do not ship to. In the event where we have your Goods, you have the options to return to sender at your own cost, ship to another TURKEY address at your own cost or request for us to dispose it. Please note our usual service fee is chargeable upon receiving your Goods.

2.8 Registering with takeandship is free.
2.9 Account Terms
The Website is provided by Take and Ship and available only to entities and persons over the age of legal majority who can form legally binding agreement(s) under applicable law. If you do not qualify, you are not permitted to use the Website.
You must provide your full legal name (which will be used as the only recipient name for all your shipments), current address (where your packages will be forwarded to), a valid email address, and any other information needed in order to complete the signup process.
You are responsible for keeping your password secure. Take and Ship cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
You may not use the Take and Ship service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.
A breach or violation of any of the Account Terms as determined in the sole discretion of Take and Ship will result in an immediate termination of your services.
2.9.1 General Conditions
You may not defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
You may not publish, post, advertise, distribute, disseminate, or upload any defamatory, infringing, obscene, indecent or unlawful material or information.
You may not upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control all necessary rights to the files or have received all necessary consents.
You may not upload files that contain viruses, corrupted files, or any other similar software, code, or programs that may damage the operation of another’s computer.
You may not delete or modify any author attributions, legal notices or proprietary designations or labels in any information that is published, posted, advertised, distributed, disseminated, or uploaded.
You may not falsify the origin or source of information or material published, posted, advertised, distributed, disseminated, or uploaded.
You may not conduct or forward surveys, contests, chain letters, or commercial solicitations.
You may not download any material or information published, posted, distributed, disseminated, or uploaded by another user that you know, or reasonably should know, cannot be legally distributed in such manner.
You may not provide, distribute or upload personal information of others without their express permission.
You may not access or attempt to access the Website’s information technology systems, environments, networks, files, data or accounts to which express authorization has not been obtained, or log into a server that you are not authorized to access.
You may not attempt to circumvent or subvert system or network security mechanisms, or probe the security of any system, network, or account associated or used in conjunction with this Website.
You agree that Take and Ship has the right to use, reproduce, copy, modify, publish, distribute, perform and display information (in whole or part) that you post to publicly accessible areas of the Website or other platforms on a public basis.
Any use in contravention of this provision or any provision of this Terms of Service is at your own risk and, if any part of this Terms of Service is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall govern such use.
The failure of Take and Ship to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Take and Ship and govern your use of the Website, superseding any prior agreements between you and Take and Ship (including, but not limited to, any prior versions of the Terms of Service).
3. Using the Services
3.1 User acknowledges and agrees that the services do not include customs or taxes (except where clearly stated) and that we are not a customs agent or broker. Take&Ship acts solely as a parcel forwarding and shipping intermediary. Unless expressly stated otherwise, customs clearance services are not included. The User is solely responsible for complying with all import regulations and for paying any customs duties, taxes, tariffs, brokerage fees, or other governmental charges imposed by the destination country.
3.2 Take&Ship operates between 09:00 and 17:30 (Türkiye Time) Monday through Friday and between 09:00 and 12:30 (Türkiye Time) on Saturdays. We do not operate on official public holidays in Türkiye. Users are responsible for informing Suppliers of these operating hours when arranging deliveries. We shall not be liable for any Goods delivered outside our operating hours.
3.3 It is your responsibility to ensure that any manufacturer’s warranty is available and valid in the country that you are based.
3.4 By placing an order with us or using our service, you agree that the Goods have been purchased from a Supplier that is authorised to sell the Goods in the country that you are based.
3.5 You must use the Türkiye Delivery Address provided by Take&Ship when placing orders with Suppliers for forwarding through our Services.
3.6 You authorise us to accept delivery of Goods at the Turkey Delivery Address on your behalf and appoint us as your freight agent to ship the Goods to the Shipment Address in accordance with these Terms and Conditions.
3.7 We will charge fees for the use of our Services unless expressly stated otherwise. Such fees may include, but are not limited to, shipping charges, handling fees, consolidation fees, storage fees, insurance fees, repacking fees, and any other applicable service charges.
All fees and charges are subject to change from time to time without prior notice. The fees applicable to a Shipment shall be those in effect at the time the User requests shipment and completes payment. If shipping charges or other applicable fees have not yet been paid, Take&Ship reserves the right to apply the rates and charges in effect at the time of payment.
Any shipping quotation, estimate, or calculation provided by Take&Ship prior to payment is for informational purposes only and may be revised before payment is received. Take&Ship reserves the right to amend shipping rates where carrier rates, fuel surcharges, dimensional weight calculations, customs requirements, taxes, duties, or other shipping-related costs have changed.
All fees paid to Take&Ship are non-refundable except where otherwise expressly stated in these Terms and Conditions or where required by applicable law.
3.8 We reserve the right, without prior notice, to open, inspect, photograph, repackage, measure, weigh, or otherwise examine any Goods received at the Türkiye Delivery Address for security, customs, regulatory, transportation, insurance, operational, or compliance purposes. We shall not be liable for any damage resulting from such inspection except where caused directly by our gross negligence or wilful misconduct.
3.9 Notwithstanding any provisions herein, We reserve the right to refuse, reject, return, dispose of, or otherwise decline to handle any Goods at our reasonable discretion, including where such Goods may violate these Terms and Conditions, carrier requirements, customs regulations, or applicable laws.
3.10 You are responsible for maintaining the confidentiality of your account details and assigned delivery address. Any Goods received under your membership number shall be deemed to have been authorised by you. We will assume that any Goods we receive from a Supplier to your Turkey Delivery Address have been ordered by you for us to forward to your Shipment Address. It is important not to pass on details relating to your membership of the Site to anyone that is not authorised to arrange for Goods to be sent to your Turkey Delivery Address.
3.11 You must agree not to use your Turkey Delivery Address, including declaring it as your residential address, in the application for, renewal of or replacement of any official documents. This includes but is not limited to using your Turkey Delivery Address in setting up business or company, applying for driving licenses, credit cards, mortgages, loans or passports. We will not forward official documents to you and will dispose of them as we see fit. You must also not provide your Turkey Delivery Address as your address to any governmental, regulatory, legal or financial organisation. Any official documents received may be refused, returned, destroyed, or otherwise disposed of at our discretion and without liability.
3.12 All prices are quoted in United States Dollars (USD) unless otherwise stated.
3.13 We only accept orders submitted through the Site or through authorised Take&Ship email addresses. or via e-mail to contact@takeandship.com or support@takeandship.com
3.14 You must not arrange for Goods with a declared value exceeding USD 1,000 or an actual or volumetric weight exceeding 30 kg to be delivered to the Türkiye Delivery Address without obtaining our prior written approval. We reserve the right to refuse such Goods or apply additional handling, storage, insurance, or shipping fees.
3.15 We can store Goods which we receive at your Turkey Delivery Address for up to 45 days without charge whilst we await your instructions to ship and your payment for shipping to your Shipment Address. After this time we will charge a daily storage fee for each package we have stored beyond 45 days. The fee for each package will accrue daily until the package is shipped or disposed of. The fee we charge for storage is set out on the Site or in an email we send you before the charge is incurred. We reserve the right to dispose of, auction, abandon, or otherwise deal with unclaimed Goods after providing reasonable notice to the User.
3.16 The User must not send any Goods that are prohibited, restricted, hazardous, dangerous, illegal, embargoed, or otherwise listed under Section 10 (Prohibited and Restricted Items) of these Terms and Conditions.
3.17 Customs Clearance, Returns, and Disposal
All Shipments are forwarded on a Delivery Duty Unpaid (DDU) basis unless otherwise expressly stated by Take&Ship. The Receiver shall be solely responsible for all customs duties, taxes, import fees, brokerage charges, inspections, penalties, and clearance costs imposed by authorities in the destination country.
If a Shipment is refused, unclaimed, undeliverable, detained, returned, abandoned, confiscated, destroyed, or otherwise cannot be delivered for any reason beyond Take&Ship’s control, the User shall remain responsible for all resulting transportation costs, storage charges, customs charges, disposal fees, carrier fees, penalties, and administrative expenses.
Take&Ship shall not be liable for any losses arising from customs actions, regulatory inspections, seizures, delays, confiscations, or destruction of Goods by governmental authorities.
4. TakeandShip
4.1 “TakeandShip” is a service provided by us for registered User. User arrange to deliver their Goods order from Suppliers to Turkey Delivery address and for us to forward it on to the Shipment Address designated by the User.
4.2 When we receive your Goods, we will measure and weigh the Goods and arrange the forwarding of your Goods to the your address by a Courier of your choice from the list we provide you. As soon as you decided on the Courier and we receive full payment from you, we will dispatch the Goods to your Shipment Address. Shipping insurance cover from the Turkey Delivery Address to your Shipment Address is available and it is optional. Please see Section 11 for full details about shipping insurance.
4.3 If you are ordering directly from the Supplier, the title of the Goods shall remain with the Supplier until you make full payment for those Goods to the Supplier, at which point title will pass on to you.
4.4 We may choose to perform any of the following activities on User’s behalf: Complete any documents, amend product or service codes, and pay any duties or taxes required under applicable laws and regulations (if applicable); and/or act as User’s freight agent for the performance of customs clearance and preparation of shipping documents. Item declaration amount will be based on the Supplier invoice of the package. The Supplier invoice will be used as supporting documentation.
4.5 The User is responsible for ensuring that the Shipment Address provided is accurate and complete. Once a Shipment has been dispatched, the Shipment Address may not be changed. Where payment is made through a third-party payment provider, Take&Ship reserves the right to ship only to the verified address associated with the payment transaction or the address approved by Take&Ship’s fraud prevention procedures.
4.6 The User acknowledges and agrees that Shipments may be routed through intermediate locations, transit hubs, consolidation centres, or third-party facilities as determined by Take&Ship, the selected Courier, or transportation providers.
4.7 For shipping services that require delivery to a designated carrier facility prior to international forwarding (“two-legged shipping services”), the User authorises Take&Ship to arrange transportation of the Goods from the Türkiye Delivery Address to the carrier’s designated facility using a Courier, freight provider, parcel broker, or other transportation provider selected by Take&Ship.
4.8 Take&Ship reserves the right to refuse service to, suspend service to, or decline shipments destined for any country, territory, region, individual, entity, or organisation that is restricted by applicable laws, sanctions regulations, carrier restrictions, security requirements, or Take&Ship operational policies. A current list of restricted destinations may be published on the Site and may be updated from time to time without prior notice.
4.9 Take&Ship does not act as the seller, manufacturer, distributor, importer, or owner of any Goods. We make no warranties regarding the quality, authenticity, legality, safety, condition, suitability, or fitness for purpose of any Goods purchased by the User from a Supplier.
5. Take for me Service ( Shopping Assistance )
5.1 We provide product ordering Take for me service to Users to assist them to purchase Goods from on-line Suppliers who may or may not otherwise accept their payments. We also offer assistance to purchase Goods from off-line Suppliers located within 15 km radius from our location. We are not a retailer or reseller of the Goods ordered, we are acting as your agent ordering on your behalf. All Take for me orders once placed are considered final, hence strictly nonrefundable.
5.2 We will charge you a fee for using the Take for me Service (the Take for me Service Fee). You must pay the full price of the Goods plus any cost for delivering the Goods to Turkey Delivery Address and the Take for me Service Fee before we can place any order with the Supplier. After we have received the Goods at your Turkey Delivery Address, we will contact you to arrange the forwarding of those Goods to your Shipment Address using Take for me Service.
5.3 You authorize us to place an order for Goods on your behalf and appoint us as your agent to ship the Goods to the Shipment Address in accordance with these Terms and Conditions. We do not accept any liability in relation to any Goods we order, except to the extent expressly set out in these Terms and Conditions, if the Goods are faulty or loss during transit from the Supplier to Turkey Delivery Address, you will contact the Supplier of the Goods directly and not us.
5.4 The fee for off-line assisted purchase of Goods from Suppliers within 15 km radius from our warehouse is USD 25,00 for a maximum of 10 item from a single Supplier. You must pay the full price of the Goods and the fee for using the off-line assisted purchase of Goods before we can make the purchase,
in case you need a pick-up service we charge a USD 20,00 standard fee for the Pick up Service (if higher pick-up costs occur, we will discuss with you before executing the pick up).
5.5 We do not warrant that the items Users have ordered will be available for purchase and delivery. We will automatically cancel any item ordered if it is:-
- Out of stock;
- Back-ordered;
- Available only at a higher price of more than 10% the price charged by your nominated Supplier;
- Ordered with ambiguous or insufficient information that is, in our sole opinion necessary to place the order; or
- Items unsuitable to be transported by our freight agents.
5.6 If User has selected the option to process incomplete orders, we will without notification, process the rest of the order. Otherwise, the entire order will be cancelled.
5.7 While we will endeavor to make prompt execution of orders, User agrees that we will not be responsible for any delays. We reserve the right to reject any orders, at our discretion, at any time. We do not accept any requests to amend or cancel orders placed using the Take4me Service. All orders once placed are considered final, hence strictly nonrefundable.
5.8 You agree that we may, should we choose to, obtain identical Goods from an alternative Supplier to your nominated Supplier. This is subject to the price charged by that alternative Supplier is the same or less than or no more than 10% the price charged by your nominated Supplier. We are not required to pass on to you any cost savings or commission we gain as a result of obtaining the Goods from an alternative Supplier in this way.
5.9 We will take all reasonable care to place User’s orders correctly. Should there be any discrepancies User must bring them to our attention within three working days of us sending User the Supplier confirmation. After that, all errors are deemed to be accepted by User.
5.10 Some Suppliers may insist that we do not forward their merchandise outside of the TURKEY. We are not responsible for any change in any merchant’s selling restrictions.
5.11 Orders that are deemed to be unacceptable Shipments will be dealt in accordance with Section 10.
6. Supermarket Shopping Service
6.1 Supermarket Shopping is a service provided by us for registered User. User arrange to deliver their Goods order from Suppliers, mainly Supermarkets, to your Turkey Delivery address. The Goods, if more than one item require us to repackage before forwarding it on to you using TakeformeService. The TakeformeService fee is included in Supermarket Shopping Service Fee.
6.2 When placing an order for Supermarket Shopping Service you must book a time slot on weekdays during our office opening hour and inform us prior to the delivery of the Goods by email at support@takeandship.com the number of deliveries, expected time and date of delivery.
6.3 We do not accept perishable and frozen Goods for obvious reason
6.4 You also agree that we are not responsible for the state and condition of the Goods we receive from the Supplier. When we received the Goods at our warehouse, we pack the Goods before forwarding it on to the Shipment Address designated by the User. We do not accept any liability for any inaccurate Goods, Goods that are unacceptable in condition or damage.
6.5 Packing is included for Supermarket Shopping Service, but we may choose to charge User additional fee, if we find the Goods are substantially heavier and larger than what we can accommodate making it difficult in repackaging. There is a fee for packing fragile Goods
6.6 Sometimes the Supplier delivers substitute Goods replacing those not in stock, which we normally reject. If you would like us to accept substitute, then let us know by email at support@takeandship.com. Unfortunately, we can only either accept or reject all substitutes not choose and pick.
7. Verification
7.1 Take&Ship reserves the right, at any time, to verify the identity, address, payment method, and ownership of an account before providing Services or releasing any Goods or Shipments. To complete verification, we may request copies of documents including, but not limited to:
(a) one document showing the User’s full name and residential address, such as a utility bill, bank statement, credit card statement, government correspondence, or similar document; and
(b) a copy of the User’s passport, national identity card, driving licence, or other government-issued photo identification.
All documents must be valid, unaltered, legible, and clearly show all four corners of the document where applicable.
7.2 Verification may be required during account registration, before shipment, after receipt of Goods, following a payment review, or whenever Take&Ship reasonably believes additional verification is necessary. We may request further information or documentation, including but not limited to proof of purchase, supplier invoices, payment confirmations, proof of ownership of the payment method used, bank statements, or other documents necessary to verify the legitimacy of a transaction.
The User authorises Take&Ship to contact Suppliers, payment providers, financial institutions, shipping carriers, or other relevant parties for the purpose of verifying transactions and preventing fraud.
Failure to provide requested verification documents within a reasonable period may result in delays, suspension of Services, cancellation of shipments, refusal to release Goods, account suspension, or treatment of the Goods as Abandoned Goods in accordance with Section 8.5.
7.3 Take&Ship reserves the right to refuse service, reject transactions, cancel orders, withhold Goods or Shipments, suspend accounts, or dispose of Goods where we reasonably believe that:
(a) fraudulent activity may have occurred;
(b) false, inaccurate, or misleading information has been provided;
(c) a payment method has not been satisfactorily verified;
(d) a transaction violates applicable laws, regulations, sanctions, or these Terms and Conditions; or
(e) the User fails to comply with any verification request.
Take&Ship shall not be liable for any loss, delay, storage charges, disposal costs, or other consequences arising from a User’s failure to complete verification requirements.
7.4 Take&Ship may retain copies of verification documents for compliance, fraud prevention, legal, regulatory, security, and record-keeping purposes in accordance with its Privacy Policy and applicable data protection laws.
8. Deliveries, Undeliverable and Storage
8.1 TakeandShip does not guarantee delivery of packages which do not comply with the import or export regulations of the country to which they are delivered to. It is the responsibility of the User to ensure that the Goods are not restricted or prohibited by the country to which they are delivered to.
8.2 If the recipient refuses delivery or the Goods is deemed to be unacceptable, or it has been undervalued, or the Recipient cannot be reasonably identified or located, or the Recipient does not provide paperwork as requested by custom or Courier, or the Recipient does not respond or reply to emails requesting for payment of custom duties, freight charges or handlings prior to the uplift or delivery of the Goods, we shall use reasonable efforts to return the Goods to the Supplier at User’s cost, failing which the Goods may be released, disposed of or sold by us without incurring any liability, with the proceeds applied against service charges and related administrative costs.
8.3 We will store Goods which we receive at your Turkey Delivery Address for up to 45 days without charge whilst we await your instructions to ship and your payment. After this time we will charge a daily storage fee for each package we have stored beyond 45 days. The fee for each package will accrue daily until the package is shipped or disposed of. The fee we charge for storage is set out on the Site or in an email we send you before the charge is incurred.
If you decide to route your package a domestic address you can contact us and we will send your package to your location in Turkey after receiving the local delivery payment fees from you. Note: you will also be charged a 2 USD per package per day storage fee for your items since free storage policy only covers package that are shipped.
8.4 Notwithstanding anything contained herein, we reserve the right to discard and/ or dispose of the Goods delivered to the Turkey Delivery Address in any manner we deem fit without being liable to the User, if your Goods are deemed as Abandoned Goods.
8.5 You agree that the following can be treated by us as Abandoned Goods:
(a) they remain in storage for more than forty-five (45) days and the User has not arranged shipment or collection;
(b) storage fees remain unpaid for more than thirty (30) days after becoming due;
(c) the User fails to respond to communications relating to the Goods within thirty (30) days;
(d) the owner of the Goods cannot be reasonably identified within thirty (30) days of receipt;
(e) the User fails to provide requested verification documents within thirty (30) days of request;
(f) the User has unpaid invoices outstanding for more than sixty (60) days;
(g) Take&Ship reasonably suspects fraud, unlawful activity, payment disputes, chargebacks, or misuse of the Services; or
(h) the Goods cannot legally be shipped, returned, delivered, or otherwise handled.
Any proceeds obtained from the sale of Abandoned Goods may be applied towards outstanding fees, storage charges, shipping charges, administrative expenses, disposal costs, and any other amounts owed to Take&Ship.
8.6 You will be regarded as the importer of any Goods that we send to you through the Services and it is your responsibility to comply with all laws and regulations of the country in which the Goods are to be delivered. Such Goods may be subject to opening and inspection by customs authorities.
8.7 Extra surcharge for remote areas. Remote areas are generally either less populated or less accessible locations.
For certain remote and less-accessible locations an additional remote area surcharge is applied to cover additional costs incurred.
A Remote Area Surcharge is an additional fee applied by couriers for shipments made to and from locations that the courier deems to be in remote areas.
This means that if the courier does not have a depot near the pickup or delivery address your shipment may be subject to a remote area surcharge.
These are fees applied by the courier and they will show up as adjustment charges on your takeandship.com balance account.
8.8 Take&Ship shall have a general lien over all Goods in its possession for any amounts owed by the User, including shipping charges, storage fees, customs charges, administrative fees, and any other outstanding amounts. Take&Ship may retain possession of Goods until all outstanding amounts have been paid in full.
9. Loss, Damage,Delay to Shipment, Insurance & Liability
9.1 Take&Ship will use reasonable efforts to process and dispatch Shipments promptly following receipt of all required payments, documentation, and shipping instructions. Any delivery estimates, transit times, processing times, or delivery schedules provided by Take&Ship or a Courier are estimates only and are not guaranteed. Take&Ship shall not be liable for any delay in processing, dispatch, transportation, customs clearance, delivery, or receipt of Goods.
9.2 Where the User purchases Goods directly from a Supplier, the User is solely responsible for arranging delivery from the Supplier to the Türkiye Delivery Address. Take&Ship assumes no responsibility for Goods until they have been physically received and recorded at the Türkiye Delivery Address. Take&Ship shall not be liable for any loss, damage, delay, misdelivery, theft, or non-delivery occurring prior to receipt of the Goods at the Türkiye Delivery Address, including errors made by the Supplier, carrier, or any third party.
9.3 Shipping insurance may be available for eligible Shipments in accordance with Section 11. Standard Insurance and Extended Insurance, where offered, apply only during the period in which the Goods are in transit from the Türkiye Delivery Address to the Shipment Address and are subject to the terms, exclusions, conditions, and limitations set out in Section 11.
The User is responsible for purchasing any optional Extended Insurance if additional coverage is desired. Insurance coverage shall not apply to prohibited goods, restricted goods, improperly declared goods, illegal goods, perishable items, fragile items not adequately packaged, or any items excluded under these Terms and Conditions or the insurer’s policy.
9.4 Any claim for loss or damage must be submitted in accordance with the claims procedure set out in Section 11. Only one claim may be submitted per Shipment. Compensation shall be limited to the applicable insurance coverage purchased for the Shipment and shall never exceed the declared value accepted by the insurer or carrier.
Unless otherwise specified in the applicable insurance policy, compensation may include the value of the Goods and the shipping charges paid for the affected Shipment.
9.5 The User is solely responsible for ensuring that the Goods may lawfully be imported into the destination country. Any Shipment containing prohibited, restricted, controlled, regulated, embargoed, or non-compliant Goods shall be shipped entirely at the User’s risk. Take&Ship shall not be liable for any loss, damage, delay, confiscation, seizure, destruction, return, penalty, fine, or expense arising from such Goods.
9.6 Take&Ship shall not be liable for customs delays, customs inspections, customs holds, customs clearance failures, import restrictions, licensing requirements, duties, taxes, or any actions taken by customs authorities or governmental agencies. If the User or Recipient fails to provide required customs documentation, information, permits, licences, declarations, payments, duties, taxes, or other requirements imposed by customs authorities, any resulting delay, storage, return, confiscation, destruction, abandonment, or loss shall be the sole responsibility of the User.
The User agrees not to dispute, reverse, charge back, or otherwise challenge shipping charges, handling fees, customs-related expenses, or service fees arising from such circumstances.
9.7 Take&Ship acts solely as a parcel forwarding and logistics service provider. Except where prohibited by applicable law, Take&Ship shall not be liable for any indirect, incidental, consequential, special, punitive, or economic losses, including loss of profit, loss of revenue, loss of business opportunity, loss of use, loss of goodwill, or loss of data.
9.8 To the maximum extent permitted by law, Take&Ship’s total aggregate liability arising from or relating to any Shipment, Goods, Service, transaction, or claim shall not exceed the lesser of:
(a) the amount of shipping fees paid to Take&Ship for the affected Shipment; or
(b) the amount recoverable under any applicable insurance coverage purchased for that Shipment.
9.9 Take&Ship shall not be liable for any loss, damage, delay, non-performance, or failure to perform resulting from events beyond its reasonable control, including but not limited to natural disasters, floods, earthquakes, fires, pandemics, epidemics, war, terrorism, civil unrest, strikes, labour disputes, transportation disruptions, customs actions, governmental restrictions, sanctions, carrier failures, cyber incidents, power failures, or other force majeure events.
9.10 Any claim against Take&Ship relating to loss, damage, shortage, delay, or non-delivery must be submitted in writing within fourteen (14) days of delivery, or within fourteen (14) days of the expected delivery date in the case of non-delivery. Failure to notify Take&Ship within this period shall constitute a waiver of the claim.
9.11 Insurance claims are subject to review and approval by the applicable carrier, insurer, or claims administrator. Submission of a claim does not guarantee approval or payment. Take&Ship shall not be liable for any decision made by a carrier, insurer, or third-party claims administrator regarding claim eligibility or compensation.
[ ] I understand that I am responsible for all Customs & Import Taxes. I acknowledge that my country’s customs authority may charge duties or taxes on this shipment. I agree to pay these fees directly to the carrier/customs. I understand that if I refuse to pay, my package may be destroyed and I will not be eligible for a refund of the shipping fees or item value.
By using Take&Ship services, the Customer acknowledges that all shipments are sent under Delivery Duty Unpaid (DDU) terms unless otherwise specified. The Customer is solely responsible for any import duties, taxes, customs brokerage fees, storage fees, or penalties imposed by the destination country. Failure to pay such charges shall not constitute grounds for a refund of shipping charges, service fees, or item value.
10. Unacceptable and Prohibited Goods
10.1 It is your responsibility to ensure the Goods are acceptable and not prohibited for us to deliver.
10.2 User agrees that Goods will be deemed unacceptable for shipment if:
- It is classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organisation), any applicable government department or other relevant organisation
- No customs declaration is made when required by applicable customs regulations; or
- We decide that we cannot transport the Goods safely or legally
10.2 Goods deemed unacceptable or prohibited for shipment will be returned to the Supplier at User’s cost or disposed of. Our decision is final. You will indemnify us and keep us and our employees, sub-contractors and agents indemnified against any and all resulting losses, damage and/or injuries.

10.5 If Prohibited Goods are sent to us, we will deal with them as we see fit which may include disposal (and will charge you for any costs and expenses we incur); and you will indemnify us and keep us and our employees, sub-contractors and agents indemnified against any and all resulting losses, damage and/or injuries.
10.6 Restricted Goods may be shipped in certain circumstances with limited liability. The following items are restricted goods and have limited Standard and Extended Shipping Insurance liability cover. If it is not covered, you are shipping entirely at your own risk, understanding that there is no compensation for loss, damage or non-delivery.
11. Claims and Insurance
11.1 Extended Shipping insurance is optional and it is your responsibility to insure the Goods for shipping from the Turkey Delivery Address to your Shipment Address. It is always recommended to insure your Goods to the full value of the Goods. Shipping insurance does not cover Goods that are prohibited and restricted to be imported into your country and as listed in Section 10
11.2 TakeandShip Shipping Insurance is offered by us to cover both the cost of shipment and damages to outgoing shipments due to loss or damage from external causes during shipment. The fee for the service we provided is strictly non-refundable
11.3 Shipping insurance cover is not available for shipping services without tracking
11.4 Depending on the selected Carrier and shipping service, eligible tracked shipments may include Standard Insurance coverage of between USD 25 and USD 50 at no additional charge. The amount of Standard Insurance applicable to a Shipment shall be determined by the selected Carrier and shipping service and may be updated from time to time without prior notice.
11.5 Extended insurance coverage is available for shipping using courier at a cost of usd5 per usd100 unit of insured value. This rate is not prorated for partial units of usd100
11.6 Shipping insurance coverage using courier including but not limited to FEDEX, ARAMEX, SMSA, TURKISH POSTAL SERVICE, DHL, DPD, UPS is limited to a total value of usd 2,500.00 per parcel or per multi-parcel shipment.
11.7 If you elect to purchase Extended TakeandShip Shipping Insurance, you must insure the entire declared value of your parcel and shipping cost or up to the maximum shipping insurance available for the selected Carrier.
11.8 TakeandShip insured values cannot exceed the actual value of the items. Values on your customs declaration are used to determine the TakeandShip insured value.
11.9 Prohibited items are excluded from the shipping insurance cover. Items that are prohibited for import into your countries are excluded from the shipping insurance cover. It is your responsibility to ensure that the items can be shipped to your country. List of prohibited items are listed in 10.4
11.10Restricted Goods may be shipped in certain circumstances with limited liability. The items listed in 10.6 are restricted goods and have limited Standard and Extended Shipping Insurance liability cover
11.11 In cases of lost, missing, or non-delivered parcels, claims must be submitted to Take&Ship Support or by email to support@takeandship.com no later than thirty (30) days from the expected delivery date or such longer period as may be required by the applicable carrier’s claims policy.
- You will be responsible for submitting any documents requested by our TakeandShip Support, including but not limited to evidence of value for the affected items.
- Once we receive your claim, we will file an official inquiry with the carrier to confirm the loss of the parcel. When we receive such official confirmation of loss, we will issue payment on your claim.
- If we cannot confirm the loss with the carrier, we will require additional documentation to complete your claim.
- If your parcel is delivered subsequent to our payment of your claim, you will be responsible for repayment to us of the full amount of the claim
11.12 In case of damage to items in a delivered parcel, or loss of individual items within a delivered parcel, claims must be submitted to our TakeandShip Support within three calendar days of delivery.
- You will be responsible for providing photographic evidence of damaged items, and any other documentation we may request to substantiate the claim.
- In case of loss of an individual item within a package, parcels must be opened in the presence of the delivery agent and an official complaint must be filed with the delivery carrier. Evidence of this filing must be provided to us to substantiate your claim.
11.13 TakeandShip Shipping Insurance covers only damage or loss occurring in transit, after a parcel leaves our warehouse. Damage occurring prior to shipment or prior to receipt in our warehouse is not covered.
11.14 TakeandShip Shipping Insurance does NOT cover financial damages arising from any of the following circumstances:
- Delay, loss or non-delivery due to the actions of any government authority, including customs and border protection authorities.
- Damages arising from a loss of market value, decay, or defects in the product itself.
- Incidental or cosmetic damage to product packaging, when the item itself is undamaged.
- Claims for reimbursement of postage fees for delivery delays, whatever the cause.
- Leakage or damages caused to the package or items by leakage of another product
11.15 The following conditions, if applicable, render TakeandShip Shipping Insurance void:
- Any items in the parcel were shipped in violation of our shipping terms, including prohibited items or items inaccurately declared on customs documents.
- Loss, damage, shortage or non-arrival of parcel is due to the parcel being insufficiently addressed for delivery.
- Loss, damage, shortage or non-arrival of parcel is due to the parcel containing items which were not properly disclosed, including but not limited to: lithium-ion batteries, perfume, or any prohibited items.
- Loss, damage, shortage, or non-arrival arising from the Recipient’s refusal to accept delivery, failure to collect the Shipment, failure to provide required information, or failure to cooperate with the carrier.
- Loss, damage, shortage or non-arrival due to an act of war or war-like actions.
- The User initiates a chargeback, payment dispute, or payment reversal relating to the Shipment or Services before resolution of the insurance claim.
You understand the insurance DOES NOT COVER:
- Any damage of the luggage/bag/box, consider luggage/bag/box as packaging materials. It is your responsibility to select proper and strong luggage/bag/box for the transportation. You acknowledge that TakeandShip is not able to file a damage claim only for damaged packaging materials.
- Fragile items including any breakable or temperature sensitive items
- Glassware including, but not limited to, signs, mirrors, ceramics, porcelains, china, crystal, glass, framed glass, and any other commodity with similarly fragile qualities
- Electronics including, but not limited to, laptops, cameras, personal computers, stereo equipment, personal audio devices, cell phones, TV. Electronics may be covered only where specifically accepted by the selected carrier and insurer, and only up to the limits imposed by such carrier or insurer.
- Antiques, collector’s items, precious metals and gems, works of art, precious jewelry
- Any prohibited items listed in our terms and conditions, or any prohibited items prohibited or restricted by local, country, international law or regulation,
- Shipment delays, including but not limited to customs delays
You also understand the shipping insurance does not cover the loss or damage arising from following circumstances:
- Strike, lock-out, stoppage or restraint of labor, Customs delay, the consequences of which we are unable to avoid by the exercise of reasonable diligence
- Acts of God
- Consequence of War or Terrorism
- Any item damaged or lost because of your / merchandiser improper packing, not requested extra packing materials or/and labeling. You understand that your items must be thoroughly packaged and must be able to fall approximately 96 cm without breaking.
- Any item damaged or lost because of improper outer container (box, luggage or bag) you used for the shipment. You understand that the outer container you select should be sturdy enough to hold and protect all items inside it. It should also be strong enough for other packages to be stacked on it in transit.
- Any lost or damage after package has been signed for and accepted at the wrong or incomplete delivery address provided by you
- Any lost or damage after package has been delivered without signature request
- Any lost or damage before the carrier pick up the shipment, or before the carrier accepted the drop off package.
- You failed to adhere to the terms and conditions set out in these conditions
11.16 Approved claims may be paid as account credit, balance credit, refund, or other compensation method determined by Take&Ship in its sole discretion. Acceptance of any claim payment constitutes full and final settlement of the claim and the User waives any further rights, claims, or actions arising from the same incident, loss, damage, or Shipment.
11.17 Submission of a claim does not guarantee approval or payment. All claims are subject to verification by Take&Ship and, where applicable, by the carrier, insurer, or claims administrator. Take&Ship reserves the right to request additional documentation, reject incomplete claims, reject fraudulent claims, or deny claims that do not comply with these Terms and Conditions. The decision of Take&Ship and any applicable carrier or insurer regarding claim eligibility and compensation shall be final.
11.18 Take&Ship reserves the right to offset any approved claim payment against any outstanding fees, storage charges, shipping charges, customs charges, administrative fees, or other amounts owed by the User.
11.19 Take&Ship Shipping Insurance is provided subject to the limitations, exclusions, conditions, and maximum liability limits stated in these Terms and Conditions. In all circumstances, the maximum compensation payable shall not exceed the insured value accepted by Take&Ship, the applicable carrier, or insurer, whichever is lower.
12. Refund, Return and Exchange
12.1 We are not responsible for any errors by the Supplier in fulfilment of orders or otherwise. User will have to make arrangements with the Supplier for any returns, refunds or exchanges of Goods directly in accordance with the Supplier’s terms and policies. TakeandShip will provide assistance to make the returns, refunds and exchange possible.
12.2 We will facilitate the return delivery of Goods ordered from the Supplier while the goods are at the User’s Türkiye Delivery Address or at User’s Shipment Address. Applicable return and exchange fees apply.
12.3 All Shipping and any duties or taxes associated with the return or exchange will be the sole responsibility of the User.
12.4 We will return and exchange the Goods according to User instructions as to where to deliver the Goods.
12.5 TakeandShip accepts no responsibility for loss and damage to the return or exchange Goods. The return and exchange period is 15 days. The product you will return must have undamaged package, not used, not washed, not damaged as a result of usage error, and must be resalable. Invoice submission is mandatory for returns. Make sure that you send your products with the invoice and it will not fall out of the package during shipping.
12.6 Where applicable, we will credit User with the refunds only after we have received the refund from the Supplier. We do not refund any Service fee for Take4me Service paid or payable by the User in the event User elects to return the goods.
12.7 Return fee will be deducted from the proceeds of any order cancellations for orders placed with the Take4me service.
12.8 Where Goods are returned for exchange, replacement, repair, or warranty service, the User must pay all applicable return shipping charges, exchange fees, handling fees, and any other associated costs before Take&Ship processes the return.
12.9 For orders you made directly with the Supplier using Takeforme and Supermarket Shopping Services, you must first pay for the return or exchange fee and any return delivery charges before we can return the goods to the Supplier. We do not refund any Service fees paid to us for Takeforme and Supermarket Shopping Services.
12.10 Eligibility for any return, exchange, replacement, cancellation, warranty claim, or refund shall be determined solely by the applicable Supplier’s policies and decisions. Take&Ship does not guarantee that any Supplier will approve a return, exchange, replacement, or refund request.
12.11 Should you need to return Goods over 10 kg and up to 25 kg weight or volumetric weight, there will be additional usd15/week storage and processing fees. For over 25 kg, there will be usd25/week storage and processing fees. It may take up to 3 working days for us to get your package ready for return and we are not responsible for any delay.
12.12 Take&Ship reserves the right to refuse any return or exchange request where the Goods are prohibited, restricted, hazardous, damaged, improperly packaged, non-compliant with carrier requirements, or where the Supplier’s return conditions have not been satisfied.
12.13 The User is solely responsible for initiating any return, exchange, or refund request within the applicable return period established by the Supplier. Take&Ship shall not be liable where a return, exchange, or refund request is rejected because the applicable deadline has expired.
13. Indemnity and Limitation of Liability
13.1 The User agrees to indemnify, defend, and hold harmless Take&Ship, Serglobex Elektronik Ticaret ve Lojistik Hizmetleri Limited Şirketi, and its affiliates, shareholders, directors, officers, employees, agents, representatives, contractors, successors, and assigns from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, penalties, fines, costs, expenses, and reasonable legal fees arising out of or relating to:
(a) the User’s use of the Services;
(b) any Goods shipped, stored, handled, purchased, imported, exported, returned, exchanged, or otherwise processed through the Services;
(c) any breach of these Terms and Conditions by the User;
(d) any violation of applicable laws, regulations, customs requirements, sanctions, export controls, or import restrictions by the User or Recipient;
(e) any inaccurate, false, incomplete, or misleading information provided by the User;
(f) any customs duties, taxes, penalties, fines, assessments, or governmental charges arising in connection with the Goods or Shipment; and
(g) any claim by a third party arising from the User’s actions, omissions, Goods, or use of the Services.
13.2 The User shall remain responsible for any act, omission, negligence, misconduct, fraud, or unlawful activity committed by the User, the Recipient, the Supplier, or any person acting on the User’s behalf or under the User’s instructions.
13.3 The User agrees to reimburse Take&Ship for any costs, charges, expenses, duties, taxes, penalties, storage fees, disposal fees, legal fees, administrative expenses, or other losses incurred by Take&Ship as a result of the User’s failure to comply with these Terms and Conditions or any applicable law or regulation.
13.4 Except where prohibited by applicable law, Take&Ship shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profit, loss of revenue, loss of business opportunity, loss of goodwill, loss of use, or loss of data, regardless of whether such damages were foreseeable.
13.5 To the fullest extent permitted by law, Take&Ship’s total aggregate liability arising from or relating to any Goods, Shipment, Service, transaction, or claim shall be limited as set out in Section 9 (Loss, Damage, Delay, Insurance and Limitation of Liability) of these Terms and Conditions.
13.6 The User acknowledges that Take&Ship acts solely as a freight forwarding, purchasing assistance, consolidation, and logistics service provider and does not manufacture, own, sell, distribute, or warrant any Goods handled through the Services.
14. General
14.1 Take&Ship may engage agents, subcontractors, carriers, couriers, warehouse operators, customs brokers, service providers, or other third parties to perform all or part of the Services. Any such party shall be entitled to the benefit of all provisions in these Terms and Conditions that exclude, limit, or restrict Take&Ship’s liability.
14.2 Any formal legal notice required under these Terms and Conditions must be provided in writing and sent to the registered business address of Take&Ship as published on the Site or otherwise notified to the User. Notices shall be deemed received in accordance with applicable law.
14.3 Any failure or delay by Take&Ship in exercising or enforcing any right, remedy, or provision under these Terms and Conditions shall not constitute a waiver of that right, remedy, or provision. Any waiver shall only be effective if made in writing by an authorised representative of Take&Ship.
14.4 The User may not assign, transfer, delegate, or otherwise dispose of any rights or obligations under these Terms and Conditions without the prior written consent of Take&Ship. Take&Ship may assign, transfer, subcontract, or otherwise delegate its rights and obligations without restriction.
14.5 If any provision of these Terms and Conditions is determined by a court or competent authority to be invalid, unlawful, unenforceable, or void, such provision shall be severed to the extent necessary and the remaining provisions shall remain valid and fully enforceable.
14.6 These Terms and Conditions, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between the User and Take&Ship regarding the Services and supersede all prior discussions, representations, understandings, and agreements relating to the same subject matter.
14.7 The User acknowledges that no representation, warranty, statement, promise, or assurance not expressly set out in these Terms and Conditions has been relied upon when using the Services.
14.8 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict of law principles.
14.9 The courts of Istanbul, Türkiye shall have exclusive jurisdiction over any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, the Services, or any transaction between the User and Take&Ship.
14.10 The User agrees that Take&Ship may provide notices, invoices, statements, disclosures, updates, and other communications electronically by email, through the User’s account, or through the Site. Such electronic communications shall satisfy any legal requirement that communications be provided in writing.
14.11 If these Terms and Conditions are translated into any language other than English, the English version shall prevail in the event of any inconsistency or conflict between versions.
15. Third-Party Payment Authorization
15.1 Take&Ship may, at its sole discretion, accept payments made by a third party on behalf of a User. In such cases, the third party shall be deemed to be acting solely as the payer and shall not acquire any ownership rights, contractual rights, or entitlement to the Goods, Services, account, or Shipment unless otherwise expressly agreed in writing by Take&Ship.
15.2 Before accepting a third-party payment, Take&Ship may require the User and/or the third-party payer to provide a signed authorization letter, company letterhead authorization, proof of identity, proof of payment, or any other documentation reasonably required to verify the legitimacy of the transaction and compliance with applicable laws, regulations, and anti-fraud procedures.
15.3 The User remains fully responsible for all obligations arising under these Terms and Conditions, including payment obligations, customs duties, taxes, shipping charges, storage fees, and any other charges, regardless of whether payment is made by a third party.
15.4 Take&Ship reserves the right to refuse, delay, suspend, reverse, or reject any third-party payment where:
(a) required authorization documents are not provided;
(b) the identity of the payer cannot be satisfactorily verified;
(c) the payment appears suspicious, fraudulent, unauthorized, or unlawful;
(d) the transaction may violate applicable laws, sanctions, anti-money laundering requirements, or regulatory obligations; or
(e) Take&Ship reasonably believes acceptance of the payment may expose it to financial, legal, regulatory, or reputational risk.
15.5 Where a refund is approved, Take&Ship reserves the right to return the funds to the original payment method or to the original payer, subject to applicable laws, payment processor requirements, fraud prevention procedures, and operational policies.
15.6 Acceptance of a third-party payment does not create any contractual relationship between Take&Ship and the third-party payer beyond the processing of the payment itself.
16. Supplementary Food Shipment Transportation Undertaking

With reference to our shipment under Air Waybill No. ………………………………………, we hereby declare that the products we request to be shipped through Takeandship are solely supplementary food products.
In this regard, we declare and undertake that we have read, understood, and fully accepted the following terms and conditions:
16.1The shipped products are not medicines.
The shipped products do not contain any prescription drugs, over-the-counter medicines, or products subject to pharmaceutical licensing requirements.
16.2 As the sender, we acknowledge that the transportation of products classified as medicines is strictly prohibited. We further accept, declare, and undertake that any legal, administrative, or criminal liability arising from a violation of this prohibition shall be solely our responsibility.
16.3 In the event that any products classified as medicines are identified within the shipment, we accept, declare, and undertake that a processing fee of EUR 500 per shipment/air waybill shall apply.
16.4 We have been informed that the transportation services provided by Takeandship are limited exclusively to supplementary food products and do not include products classified as medicines.
16.5 In the event that the contents of the shipment differ from the contents declared in the shipping documents, we accept, declare, and undertake that all legal, civil, and criminal liabilities arising therefrom shall be solely our responsibility.
16.6 Takeandship’s service terms, including its Standard Terms and Conditions of Carriage, apply to all shipments.
16.7 The declaration of the shipment contents is solely our responsibility. In the event of any misleading and/or incomplete declaration, Takeandship shall bear no responsibility whatsoever. We accept, declare, and undertake that all legal, civil, and criminal liabilities, as well as any damages arising therefrom, shall be borne exclusively by us.
16.8 Takeandship shall not be held responsible for delays in customs clearance procedures, seizure of products by customs authorities, refusal of entry by customs authorities, or any similar circumstances. Responsibility for such matters rests solely with us as the sender.
16.9 Takeandship is under no obligation to provide insurance coverage for the shipped products. If insurance is requested, it shall either be arranged by us directly or, where possible, arranged by Takeandship on our behalf.
16.10 We declare and undertake that the shipments will be prepared in accordance with the security, packaging, and documentation requirements specified by Takeandship.
16.11 By signing this undertaking, we declare that the products delivered to Takeandship consist solely of supplementary food products and do not fall within any other product category. Should any discrepancy be identified, all responsibility and legal obligations shall rest solely with us as the sender.
